No Quorum, No Meeting

            Tuesday, Rochester’s Planning Board chair Arnold Johnson had to tell a hearing room packed with residents that the panel couldn’t hold its regular meeting because it lacked a quorum.

            “Sorry, folks,” Johnson said.  “We can’t open the meeting.  We can’t talk about anything on the agenda.”

            Johnson, Ben Bailey and Michael Murphy were the only members present.  Being a seven-member board, four members are required to be in attendance to reach a quorum, Johnson explained.  Town Planner Nancy Durfee tried unsuccessfully to reach by telephone the panel’s absent members to attend.

            Johnson quickly promised, however, that everything on the October 8 agenda will be on the agenda of the next meeting on October 22. Left on the docket for that meeting will be an approval request for a preliminary subdivision on 28 acres at 386 Snipatuit Road.  The proposal would add two new homes to a parcel with an existing dwelling unit.

            The board is also slated to review the Cushman Solar LLC’s plan for an Eversource electrical service pole placement on Cushman Road.  One attendee Tuesday said she was there because of the solar project but would not elaborate further.

            The Rochester Planning Board’s next meeting will be Tuesday, October 22 at 7:00 pm at Town Hall, 1 Constitution Way.

Sleep Problems and How to Fix Them

To sleep…perchance to dream

            Insomnia, dissatisfaction with sleep quality or duration, is a common problem. Some 10% of Americans have chronic insomnia and another 15-20% have occasional insomnia.

            While scientists do not fully understand why we (and virtually all living animals) need to sleep, lack of sleep contributes to many problems, including interpersonal, school and work functioning, depression and hypertension.

            There are specific medical problems that may underlie insomnia. Restless legs and obstructive sleep apnea lead this list and will respond to specific therapies. Your bed partner is more likely to pick up on these than are you, and a session in the sleep lab will usually confirm the diagnosis.

            Shift workers are particularly at risk for insomnia and the problem may not go away until you get a regular work schedule.

            Most have insomnia as its own problem. Insomnia may have started at the time of a life stress or due to jet lag and then persists.

            What can you do? There are many ‘common sense’ hints that may be all you need. Try to go to bed and get up at the same time every day, including weekends. Be sure your bedroom is dark and cool. Exercise early in the day, not in the evening. Do not work right up until bedtime; allow yourself time to decompress by relaxing reading or music. Do not eat within 2 hours of bedtime.

            If these do not work, what next?

            Sleeping pills, whether over-the-counter or prescription, are fine for short-term use but are not that effective when used chronically, and the more effective prescription drugs can have side effects.

            Older individuals are at particular risk of falls, morning confusion and even dementia with chronic use of benzodiazepines (Valium, Ativan etc.). The so-called “Z drugs,” (Zolpidem, zaleplon and eszopiclone) have black-box warnings because of sleepwalking and other potentially risky sleep behaviors.

            Sedating antihistamines like Benadryl have limited efficacy and cause dry mouth and daytime sedation. They are also potentially causes of dementia if used chronically.

            Most experts strongly recommend cognitive behavioral therapy (CBTI) before medication. The success rate is high and there are no side effects. The problem is the lack of trained therapists and the cost.

            An alternative is a web-based or phone app. These have been found to be almost as effective as in-person coaching. Two web-based programs that have good studies behind them are no longer available. I was able to download Shuteye, which promises a full year of coaching for $30 which appears good, but I have not fully tested it. Similar, and free, is Insomnia Coach, developed by the VA.

            Also recommended, for technophobes, is the book Quiet Your Mind and Get to Sleep.

            Should CBTI not work, young adults whose problem is falling asleep can try melatonin or a short-acting benzo. If sleep maintenance is the problem, low-dose doxepin or similar drugs are useful. Also approved for this use are three orexin receptor antagonists (ask your doctor!), which have fewer side-effects than benzos but are quite expensive. If you are going to use medication, be sure to also practice good “sleep hygiene” as noted above.

Buzzards Bay Watershed Ride

On Sunday, October 6, 323 riders enjoyed the Buzzards Bay Watershed Ride with perfect crisp, clear fall conditions. This annual fundraising event has become a cherished tradition, bringing together cyclists from all over Massachusetts, Rhode Island, and beyond to raise over $240,000 to advance the mission of the Buzzards Bay Coalition.

            Participants chose from 100, 75 or 35-mile course lengths that led them past coastal farmlands, windswept beaches, cranberry bogs, and scenic harbors between Rhode Island and Upper Cape Cod.

            Riders from all three courses were met by cheering crowds at the finish line in Woods Hole, and enjoyed a vibrant finish celebration featuring delicious food, beer from Westport’s Buzzards Bay Brewing, and live music provided by Falmouth favorite Puffy Elvis.

            The top fundraisers were Geoff Sullivan of Fairhaven, who raised a total of $23,255, Lizanne Campbell of Mattapoisett, who raised a total of $10,950, followed by Will Saltonstall of Marion, who raised a total of $10,575.

            The top fundraising teams were the South Coast Bikeway team, who raised $42,516 and the Sippican Sailors, who raised $73,900, including a very generous matching gift.

            Donations are being accepted until October 20 and can be made at savebuzzardsbay.org/ride. The 2025 Watershed Ride will take place on October 5.

            The Buzzards Bay Watershed Ride is one of two signature outdoor fundraising events hosted by the Coalition. The other is the Buzzards Bay Swim, a scenic 1.2-mile point-topoint open water swim from New Bedford to Fairhaven set for June 2025.

Marion Voter Information

Town Administrator Geoffrey Gorman and Town Clerk Lissa Magauran would like to remind community members of voting information for the Massachusetts State Election.

            The 2024 Massachusetts State Election will be held on Tuesday, November 5.

            All requests for Vote by Mail (VBM) ballots received by October 3 have been mailed. Any new requests for VBM ballots will be mailed as received.

            The last day to register to vote for the State Election is Saturday, October 26, 2024. The Town Clerk’s Office, located at 2 Spring Street, will be open from 9:00 am to 5:00 pm that day. Residents also may register to vote online at www.sec.state.ma.us until 11:59 pm, October 26.

            The State mailed Early Voting (EV) Application Postcards to all those who were registered to vote as of September 6 and had not yet requested a mail in ballot. Anyone who has not received an EV Application Postcard yet should contact the Town Clerk’s Office at 508-748-3502 or lmagauran@marionma.gov, and an EV Application will be mailed.

            The last day to request a vote by mail ballot is Tuesday, October 29 at 5:00 pm.

            In-person early voting will be held at the Marion Town House, 2 Spring Street, on the following dates:

            -Saturday, October 19 from 9:00 am to 1:00 pm

            -Saturday, October 26 from 9:00 am to 5:00 pm

            -Monday, October 21 through Friday, November 1 during regular business hours (8:15 am to 4:15 pm Monday – Thursday, and Friday 8:15 am – 3:15 pm)

            Absentee voting is available in the Town Clerk’s Office during regular business hours. The deadline to request an absentee ballot to be mailed is Tuesday, October 29 at 5:00pm. The deadline to vote by absentee ballot in person is Monday, November 4 at 12:00 pm.

            All ballots must be received by 8:00 pm on November 5. Please do not drop your Absentee or Vote by Mail Ballots at the polls. They must be dropped at the Marion Town House.

            Voting on the day of the Election, November 5, will take place at the Benjamin D. Cushing Community Center, 465 Mill Street, from 7:00 am to 8:00 pm

            If your voter status is inactive, you may still vote. Your driver’s license and/or a current bill tied to you and your registered voting address will be needed. Three Notices of Intent Heard

 At their September 25 meeting, the Marion Conservation Commission held several hearings on routine matters, mostly involving property additions. 

            The presence of Japanese knotweed and the presence of an elusive stream around the Wareham Avenue area drew some conversations but no controversy.

            The commission started the meeting by approving three notices of intent filed by three applicants – one for a septic upgrade, another for a screened porch in a buffer zone, as well as a deck addition.

            The proposed deck on a Brooke Haven Lane property is smaller than the original blueprint, but drew the attention of Conservation Agent/Town Planner Doug Guey-Lee for a different reason.  Guey-Lee, citing his site visit and conversations with the owner, said the applicant has been battling Japanese knotweed and was putting in mitigation measures. Guey-Lee said that the commission wants to limit them within wetland resource areas.

            According to web resources, Japanese knotweed is one the world’s most invasive plants and a top invader of wetlands, streams, and other water resources.

            Guey-Lee said keeping an eye on it is helpful for conservation commissioners. Guey-Lee also mentioned if the commission revisited that property, the presence of the knotweed would be the main concern.

            Marion Realty LLC applied for a request for determination of a stream on a lot on Wareham Avenue, which floods onto town property at times.

            Engineers reported that there is a coastal river there but the water’s height varies depending on weather. Sometimes, water levels appear like a “monsoon” while other times the area is fairly dry, making it difficult to determine the volume of wetlands in the area before new development proceeds.

            The commission put it on its next site visit list and will revisit the issue at its October 9 meeting.

            In total, the commission held six mini-hearings on issues connected to home additions, such as pool additions or other property upgrades within buffer zones.

            A West Avenue applicant proposed plans for removing and rebuilding a garage and rebuilding a seawall near a coastal beach.

            Guey-Lee said all plans look as though it will not impact the beach area but asked for erosion measures so the work does not disturb the adjacent property.

            The commission also announced it is working on a new website that is more user-friendly and does a better job highlighting the wetlands protection act and other information for a general audience.

            The site is still in progress but now has links to the state Department of Environmental Protection website, as well as commission member names and when their respective terms expire.

            “It said some things that were nonsensical and out-of-date,” said Guey-Lee of the previous web site, also stating that he and administrative assistant Natashja Molina took a look at it with fresh eyes.

            Guey-Lee asserted the commission wants to make the site more of a public resource with consistent language and readable to a general audience.

“It isn’t a Motel”

            During the October 7 meeting of the Mattapoisett Planning Board, open discussion about earth-moving activities at the motel located on Route 6 were aired. Member John Mathieu said that the owner of the property, who was never named during the discussion, had a right to perform certain activities. But he asserted several times, …”it is not a motel.” Mathieu likened the business as more of an apartment complex than motel and that over the years there had been many issues at the site. He said, “It doesn’t add anything to the town.”

            Mathieu said that people living at the “motel” had been living there on a long-term basis. The board agreed that before any redevelopment could take place, the unnamed owner would have to come before the Planning Board. He also said that construction at the site would entail drainage issues due to the hill upon which it rests.

            In other matters informally discussed, Chairman Tom Tucker inquired of Mathieu if he still was contemplating density plans, a residential overlay along Route 6 that would allow for new housing stock featuring two-bedroom units, and various styles of structures. Mathieu said that the state changes to merged lots coupled with opportunities for ADUs (accessoory dwelling units) was pushing this forward in his mind. He’ll continue researching and draft language for the board to review.

            Mathieu said, as the board took up discussions around an updated solar bylaw, that the present draft was confusing and that much of the language was unnecessary. The members will continue editing the document.

            Earlier in the proceedings the board voted not to accept the right-of-first-refusal for lots on Crystal Springs Road owned by Dennis Mahoney.

            The next meeting of the Mattapoisett Planning Board will be a public hearing set for October 21, 6:30 pm at the Fire Department conference room to receive input on ADUs in advance of spring town meeting.

Lions, Tigers, Bears, Bunnies, and Cats

            If you read this column regularly you know that from time to time I rant on unelected bureaucrats at the state and federal level dictating what we can and cannot do in our own town. What I am about to tell you falls under “you ain’t seen nothing yet.”.

            Let me introduce you to Marty the Magician. For many years Marty Hahne has performed his magic at elementary schools and children’s birthday parties around the little town of Ozark, Missouri. He is a master at vanishing little bunny rabbits. But I am getting ahead of myself.

            Some years ago, Congress passed a law designed to protect animals like lions, tigers, and bears, from neglect and abuse which required “exhibitors” like circuses, zoos, and animal acts to have a license for each of their animals. Enter Marty the Magician who had a bunny rabbit named Casey.

            Discovering this regulation Marty duly applied and received a license for Casey. The license required Marty to submit to periodic, surprise inspections of his home. Also, if he performed away from Ozark, he had to submit a detailed itinerary to the U.S. Department of Agriculture. I’m guessing, but I’ll bet by the time the U.S.D.A approved the itinerary the little birthday kids were sixteen years old. But I digress.

            After hurricane Katrina the Feds “improved” the law by requiring a contingency plan for animals’ safety during a disaster. Marty duly complied submitting a 29-page plan to protect Casey from floods, tornados, heat, chemical leaks, etc. Casey also had to be caged when not performing. The inspector declared that Marty’s plan was “pretty short” saying, since Casey was licensed, the bunny was the “most important” concern during a disaster. However, the U.S.D.A inspector mentioned that if the rabbit were raised for food, it would not need a license. Upon hearing that, Marty asked “Are you’re telling me I can kill the rabbit to eat… but I can’t take it across the street to (entertain) a birthday party without a license?” Yup. You can’t make this stuff up.

            But wait there’s more.

            Have you heard of Heminway’s cats? Ernest Hemingway the writer had a cat named Snow White who had six toes. Six toed cats are claimed to bring good luck. Not to the Hemingway Museum, a National Historic Site, which his home became after he died (the writer, not the cat). Apparently, Snow White had many offspring, all with six toes. Over the years the museum has accumulated over 60 cats that are well cared for and roam freely around the property to the enjoyment of visitors who often return just to visit the cats. They also attracted U.S. Department of Agriculture officials.

            These agents were concerned about the cats’ “containment.” They ordered the museum to hire a night watchman to ensure the felines would not escape into the neighborhood at night. Or, as an alternative, they could increase the height of the surrounding wall. (Which would be against National Historic Site regulations.) And they would need a license to keep each cat confining them in cages (like Casey the bunny). The museum refused so the Feds returned with another “suggestion” …electrify the wall and provide raised “resting” platforms for the cats. The museum complied. Well, you know what happened. While no cat vanished, like Casey the magic bunny, one got burned and another escaped jumping over the wall from its raised platform.

            Despite reluctantly complying to that rule the museum had to apply four times for the licenses, each time being rejected on a technicality. In the meantime, fines of $200 a day for each cat accumulated. The Feds persisted, sending in undercover agents dressed as tourists and even renting a house next door to secretly photograph the cats.

            After five years, a lawsuit, and spending $200,000 the museum complied with modified regulations which recognized their unique historical situation. To this day Hemingway’s cats continue to roam the museum grounds. 

            Marty the Magician continues to amaze little kids. Casey the bunny is now enjoying a happy retirement.

The Mattapoisett Yacht Club crew won the Buzzards Bay Trophy.

            In the Corinthian spirit of yachting, with the goal to increase and sustain PHRF Yacht Racing on Buzzards Bay, the following yacht clubs: Beverly Yacht Club, Buzzards Yacht Club, Mattapoisett Yacht Club, New Bedford Yacht Club, and Quissett Yacht Club, have come together in cooperation to increase participation and competition on Buzzards Bay.

The Buzzards Bay Trophy is awarded to any PHRF-NE rating yacht which has the best combined score (Spinnaker and Non-Spinnaker divisions) in four of the following eight races:

            A yacht must race in at least four of the eight races to be eligible for the prize and must have a valid rating certificate for each race in which it competes. Each boat’s race score shall be her finish position score divided by the number of boats starting in her division. Each boat’s series score shall be the total of her four lowest race scores. The lowest total points wins. Yachts may choose to sail in either cruising division or racing division. A perpetual trophy will be awarded along with the Buzzards Bay Trophy. The perpetual trophy will be adorned with the burgee of each participating club.

            Come to The Inn at Shipyard Sunday, October 20 at 4:00 pm for the trophy presentation.

            Hamburglar also competed in the ORC World Championships at the New York YC in Newport in late-September along with 19 boats in her Class.

Mattapoisett Library Artist Demonstration

Stop by the Mattapoisett Free Public Library on Sunday, October 27 between 2:00 pm and 3:00 pm to see a live demonstration by Fall River artist/exhibitor Mj Manville Cloutier. She will be working on a pastel pet portrait. During this demonstration, Cloutier is happy to speak to patrons and answer any questions about her work. Be sure to see her current library exhibit entitled “SouthCoast Landmarks and Whimsy” which includes paintings she created for the BayCoast Bank 2024 calendar, which are based on landmarks in all of their town branches. The exhibit is up until October 30.
