The Mattapoisett Conservation Commission will hold a Public Hearing on Tuesday, April 16, 2024 at 6:30 pm in the Mattapoisett Town Hall on a Request for a Determination of Applicability submitted by 18 Water Street Realty Trust.
The meeting will also be a hybrid meeting. Please contact the Conservation Commission for the Zoom information.
The Applicant proposes to pour a concrete pad within eroded areas of the lawn caused by winter coastal storms, to restore other areas of the lawn with loam and seed and to perform maintenance on the concrete/stone seawall.
Work to be performed within the 100 ft. buffer zone of a Coastal Bank and within Land Subject to Coastal Storm Flowage, Flood Zones VE (E1. 18 and 21).
The address where the activity will occur is 18 Water Street which is further identified as Lot #190 on Mattapoisett Assessors Map #9.

PUBLIC NOTICE and OPPORTUNITY FOR COMMENT ON PROPOSED DE MINIMIS IMPACT DETERMINATION ON SECTION 4(F) RESOURCES - (Washburn Park and Washburn Park Conservation Area)
PROJECT: SHARED USE PATH CONSTRUCTION (PHASE 1), FROM THE MARION-MATTAPOISETT T.L. TO POINT ROAD

PROPONENT: Town of Marion
This notice is being published to solicit public comments regarding the above-referenced federal aid transportation improvement project pursuant to Section 4(f) of the U. S. Department of Transportation (DOT) Act of 1966 (23 CFR 774). Information specific to the proposed project and its impacts, avoidance, minimization, mitigation, or enhancement measures may be obtained from: Alex Lamarche, 10 Park Plaza, Room 4260, Boston, MA 02116, alex.g.lamarche@dot.state.ma.us.
The Town of Marion in conjunction with the Massachusetts Department of Transportation (MassDOT) proposes to construct a 10-foot wide shared-use path (SUP) from the Mattapoisett/Marion town line to Point Road in Marion. The project, as designed, will require permanent and temporary easements within Washburn Park off Front Street and along Washburn Lane for construction of the shared-use path, parking area, and related improvements. The project will also require permanent and temporary easements within Washburn Park Conservation Area off Interstate 195 and Point Road for construction of the shared-use path, wetland replication area, and related improvements. The park and conservation area, which are owned by the Town of Marion, are protected as significant public recreational resources under Section 4(f) of the DOT Act.
MassDOT intends to pursue a determination that the proposed use of the permanent easements for the construction of a shared-use path, parking area, wetland replication area, and related improvements within the park and conservation area meet the definition of de minimis (or minor) impacts, as specified under 23 CFR 774.17(5). A de minimis finding is being made based on the preliminary assessment that the proposed use of this resource will have no adverse effects on the recreational activities, features or attributes qualifying it for Section 4(f) protection. All persons wishing to comment on the project should write or email to the address noted above within 15 days of this notice. Comments will become part of the official record and will be considered when making future project-related decisions.
