PUBLIC NOTICE OF ENVIRONMENTAL REVIEW
PROJECT: Single-Family House Reconstruction
LOCATION: 49 Water Street, Marion, MA
PROPONENT: John and Pamela Lee
The undersigned is submitting an Environmental Notification Form ("ENF") to the Secretary of Energy & Environmental Affairs on or before December 1, 2022.
This will initiate review of the above project pursuant to the Massachusetts Environmental Policy Act ("MEPA," M.G.L. c. 30, ss. 61-62L). Copies of the ENF may be obtained from:

Electronic copies of the ENF are also being sent to the Conservation Commission and Planning Board of Marion.
The Secretary of Energy & Environmental Affairs will publish notice of the ENF in the Environmental Monitor, receive public comments on the project, and then decide if an Environmental Impact Report is required. A site visit and/or remote consultation session on the project may also be scheduled. All persons wishing to comment on the project, or to be notified of a site visit and/or remote consultation session, should email MEPA@mass.gov or the MEPA analyst listed in the Environmental Monitor. Requests for language translation or other accommodations should be directed to the same email address. Mail correspondence should be directed to the Secretary of Energy & Environmental Affairs, 100 Cambridge St., Suite 900, Boston, Massachusetts 02114, Attention: MEPA Office, referencing the above project.

ADVERTISEMENT FOR BIDS
The Select Board of the Town of Marion, shall receive General Bids at the Marion Town House - Select Board's Office, 2 Spring Street, Marion, Massachusetts, 02738 for the Construction of Hydrant Replacements, Contract No. HYD-4A, until 2:00 PM prevailing time, Thursday, December 15, 2022. Bids submitted after this time will not be accepted. Bids will be opened and publicly read aloud at 2:30 pm prevailing time, Thursday, December 15, 2022, at the Marion Music Hall, 164 Front Street, Marion, Massachusetts, 02738.
The Work of this Contract generally consists of furnishing and installing up to eight (8) hydrants and hydrant branches at locations listed in Specification Section 01010 (Summary of Work) and noted on the locus map in Appendix A, including associated fittings, valves, appurtenances, trench paving, and site restoration, as required.
Contract Documents may be obtained electronically through the Town of Marion by contacting Meghan Davis, Engineering Manager, at mdavis@marionma.gov.

Each bid shall be accompanied by a bid security in the amount of 5% of the total bid amount and in the form described in the Instructions to Bidders. A Performance Bond and Labor and Materials Payment Bond each in the amount of 100 percent of the contract price will be required in the form described in the Instructions to Bidders.
Complete instructions for filing bids are included in the Instructions to Bidders. The bidding and award of this Contact will be under the provisions of "Massachusetts General Law, Chapter 30, Section 39M (MGL C.30, S.39M)". Each bid must be accompanied by a Certificate of Prequalification issued by MassDOT in the Sewer and Water class of work.
Minimum wage rates as determined by the Commissioner of Department of Labor and Industries under the provision of the Massachusetts General Laws, Chapter 149, Sections 26 to27H, as amended, apply to this project.
If the bidder views/obtains the plans and specifications from a source other than those noted in this Advertisement for Bids, the accuracy and/or completeness of the bid documents cannot be guaranteed and the bidder assumes the responsibility for obtaining any additional information regarding the project, including addenda, that may be required for bidding. Failure to acknowledge addenda issued during bidding shall designate a bid as non-responsive.

This Contract contains price adjustments for hot mix asphalt, diesel fuel, gasoline, and Portland cement concrete. MassDOT posts the Price Adjustments on their Highway Division's website at https://www.mass.gov/massdot-contract-price-adjustments.
No Bidder may withdraw his bid within 30 days (Saturdays, Sundays and legal holidays excluded) after the actual date of the opening of the General Bids.
The Owner reserves the right to reject any or all bids, to accept any bid, to waive any informality on bids received, to omit any item or items deemed advisable for the best interests of the Owner or to limit the extent of the Work to keep within the limits of available funds.

The Marion Conservation Commission will hold a public hearing on Wednesday, December 14, 2022, at 7:20 pm (via Zoom*), on a Request for Determination of Applicability submitted by the Beverly Yacht Club, for an existing bottom-anchored float 31-ft x 12.2-ft that was added on to the existing northern float system at Beverly Yacht Club to increase dinghy storage and access to navigable waters at 99 Water Street.
The site is further identified as Lot 180 on Marion Assessors' Map 16. Plans are available at the Town House for review.
