NOTICE OF PLANNING BOARD PUBLIC HEARING
RELATIVE TO PROPOSED AMENDMENT TO ZONING BY-LAWS
Pursuant to Massachusetts General Laws, Chapter 40A, the Planning Board of the Town of Mattapoisett will hold a Public Hearing to discuss a proposed amendment to the town's Zoning By-Laws. The Public Hearing will be held as follows: Place: Mattapoisett Town Hall/ First Floor Conference Room, 16 Main Street, Mattapoisett-MA. Date: Wednesday of April 30th, 2014 at 7:00pm. The subject matter of the proposed amendment is indicated below. The complete text relative to the proposed amendment is available for inspection during regular business hours at the following place(s). Mattapoisett Town Hall available in Town Clerks Office, Monday through Friday 8:00am-4:00pm. Mattapoisett Town Hall available in office of the Planning Board, Monday, Wednesday & Fridays 8:00am-1:00pm

3.3 PARKING

3.3.1 DEFINITION:
A "parking space" is an open or enclosed space of at least eight (8) feet wide by eighteen (18) feet long exclusive of drives and maneuvering space, located on the lot it serves and with direct access either to a street or to a driveway leading to a street, unless otherwise defined in this section.

3.3.2 GENERAL PARKING LOADING REGULATIONS:
In all districts where the use is allowed, off street parking shall be provided as follows:

Retail sales outlets 1 Space for each 200 feet of gross floor area
Restaurants or clubs 1 Space for every two (2) seats, or 1 space for each 25 square feet of public floor area, whichever is greater.
Theatres, Churches or
Places of Public Assembly 1 space for every four (4) seats or 50 square feet of gross floor area, whichever is greater.
Professional Office/Banks 1 space for each 200 square feet of floor area
Hotels, Motels or Inns 1 space for each sleeping room, plus
1 space for every two (2) employees
Barber shop/Beauty Parlor 3 spaces for each operator
Health Spas 1 space for each 50 feet of gross floor area
Bowling Alley/Tennis Courts 4 spaces for each Court
Funeral Homes 1 space for each 100 square feet or gross floor area.

BOATYARD/MARINA 1 space for every 5000 square feet of indoor and outdoor area devoted to display, sales service and storage and 1 space for every two boat slips.

HOME OCCUPATION 1 Space per room used for office, plus 1 space per non-resident employee ( in addition to residential requirement)

Reduction of Parking Requirement by Special Permit, Notwithstanding the provisions contained in section 3.3, the Mattapoisett Planning Board, may by Special Permit, reduce the number of parking spaces required of non-residential uses upon determination that the intended use of the premises can be adequately served by fewer spaces. The Planning Board may consider on street parking available near the premises as a factor in marking this determination

In parking areas with more than Five (5) spaces, individual spaces shall be delineated by painted lines, wheel stops or other means if identification.

3.3.3 RESIDENTIAL DISTRICTS

3.3.3.1 All new construction shall provide 1 space for each bedroom, plus one guest space. This section may be waived by Planning Board for any Special residential subdivision.

3.3.3.2 No lot shall have more than one (1) unregistered motor vehicle, un-garaged at any time, unless authorized by a Special Permit, from the Special Permit Granting Authority, pursuant to Section 7.2.2 of this Zoning Bylaw.

No unregistered motor vehicle or unsightly car or truck may be stored in Front Yard, which shall mean a plane across the front of the dwelling between said plane and the street line.
(This section shall not apply to Rural Residential Zones)

3.3.3.2.1 Rural Residential
No lot shall have more than four (4) unregistered motor vehicle, un-garaged at any time, unless authorized by a Special Permit, from the Special Permit Granting Authority, pursuant to Section 7.2.2 of this Zoning Bylaw.

No unregistered motor vehicle or unsightly car or truck may be stored in Front Yard, which shall mean a plane across the front of the dwelling between said plane and the street line. All vehicles shall be screened from view from roadway.

3.3.3.3 No trailer trucks, or units thereof, construction equipment, buses and vehicles of more than one ton shall be parked between the rear plane of the principal structure on the lot, and the street line, unless completely screened from view; this section shall not apply to boats, boat trailers, loaded or unloaded or recreational vehicles.

3.3.4 BUSINESS DISTRICTS (including Village Business District):

3.3.4.1 Parking facilities off the street right-of-way shall be provided on the same lot as the building for each use within the district. All off street parking shall be designed to prevent the necessity of any vehicle having to back onto the street right-of-way.

3.3.4.2 There shall be no parking within five (5) feet of the layout line of a street, way or right-of-way from which an entrance or exit is provided to or from a business property. There shall be no planting or placing of any objects or structures within the above area which will obstruct the view of vehicles entering or exiting the business property.

3.3.4.3 Each off street parking space shall be served by a two-way maneuvering lane at least twenty-four (24) feet wide, except that if the parking spaces are angled at sixty (60) degrees or less, a one way maneuvering lane may be used with a minimum width of twenty-two (22) feet. Driveways serving parking areas shall have a minimum width of twelve (12) feet per travel lane.

3.3.4.4 LOADING: The number of spaces for each proposed use shall be determined by the Inspector of Buildings based on chart contained in 3.3.2

3.3.4.5 Any parking area serving more than five (5) vehicles must provide the following sized parking spaces in a fifty -fifty combination over the initial five spaces. Fifty (50%)at eight (8) feet wide by eighteen (18) feet long and Fifty (50%) percent at ten (10) feet wide by Twenty (20) feet Long. Said Section may be waived or modified by Planning Board during Site Plan Review.

3.3.4.6 Setback: All parking areas must be set back from property lines by five (5) feet.

3.3.4.7 Screening: All parking areas must be screened from abutting Residential Zones with either man made or natural screening which is not of deciduous in character.

3.3.5 Industrial Districts/Uses

3.3.5.1 Loading: One (1) parking space shall be provided for each two employees and five (5) additional spaces for each industrial unit.

3.3.5.2 No parking shall be permitted thirty-five (35) feet of any street or way or within five (5) feet of any rear or sideline. Entrances/Exits There shall be no planting or placing of any objects or structures within the above area which will obstruct the view of vehicles entering or exiting the business property. (This Section may be waived or modified by the Planning Board during Site Plan review)

3.3.5.3 Parking located in the front of any building shall be limited to customers, visitors and /or employees. This bylaw shall not permit any shipping, receiving or storage of any materials in the parking/driveway area in the front plane of any building.

3.3.5.4 Parking facilities off the street right-of-way shall be provided on the same lot as the building for each use within the district. All off street parking shall be designed to prevent the necessity of any vehicle having to back onto the street right-of-way.

SECTION 3.4 SCREENING

INTENT AND PURPOSE

Screening provides a means of concealing excessive equipment. Equipment may be defined as automobiles, boats, materials, tools, and any other non-garaged items being stored. Screenings will be provided by business to residential.

Screening is used to provide protection to abutters from such nuisances as noise, fumes, headlight glare, dust and increased water runoff from land and/or impervious surfaces.

Storage and loading areas shall be screened from view by a tight fence and/or dense plantings which will be well maintained. The screenings will not compromise pedestrian and/or traffic safety.

3.4.1 The above provisions shall not prevent the display of goods, where sales are permitted under this By-Law, at the front or sides of the principal building.

3.5 Signs.
3.5.1 Intent and Purpose
Signs perform important functions that are essential for public safety and general welfare, including communicating messages, providing information about goods and services, and orienting and directing people. It is further recognized that because of potential detrimental impacts, signs must be regulated to:
a) Prevent hazards to vehicular and pedestrian traffic safety by controlling the number, location, and placement of signs;
b) Provide easy recognition and legibility of permitted signs and promote visual order without distracting elements;
c) Complement the historic and scenic character of the Town of Mattapoisett; and
d) Support business and community vitality through informing the public of available goods, services, and activities.
3.5.2 Application and Procedure
Application for a sign permit shall be made to the Inspector of Buildings
3.5.3 Signs in All Districts
3.5.3.1 One Identifying sign may be placed on a wall facing a street. All free standing Identifying signs All signs shall be set back at least 8 feet be erected so as not to be in conflict with the last sentence of section 3.3.4.3 obstruct the view of vehicles entering or leaving the property.
3.5.3.2 In all districts no exterior, or interior signs with an exterior effect, of the neon, flashing, moving, portable or mobile type are permitted. This section shall not prohibit signs relating to construction or improvements to the premises provided said signs are removed immediately upon completion of the work. Internal illumination of signs is not permitted. The illumination shall be derived from not more than one (1) 60 watt incandescent bulb or equivalent per side, suitably concealed by a reflecting shield to direct the illumination primarily on the sign surface.
3.5.3.3 Directional signs necessary to give clear direction to a parking lot or building entrance on the premises are permitted. Such signs shall not exceed three (3) feet in any dimension nor more than four (4) feet high on a pole or pylon unless placed on a permitted wall or building. The location of directional signs shall be determined during the Site Plan Review process.
3.5.3.4 Roof signs of any type, in any district, are prohibited. A sign or symbol attached to a building shall not project above the building wall to which it is attached, and shall not obscure any part of the roof of the building.
3.5.3.5 One (1) sign for temporary use at the site of real estate development or a construction site of not more than forty-eight (48) square feet per side shall be permitted. Such sign shall be removed on completion of the development.
3.5.4 In all districts the Planning Board Board of Selectmen may grant a Special Permit for the erection of any off premises sign for advertising.
3.5.5 In Residential Districts
3.5.5.1 One (1) sign of not more than three (3) square feet of surface per side pertaining to a permitted accessory use shall be permitted.
3.5.5.2 One (1) sign of not more than four (4) square feet of surface per side, pertaining only to lease or sale of the premises shall be permitted.
3.5.5.3 Two identification signs are permitted on each building for places of worship and institutions, one not exceeding twenty (20) square feet in area and one not exceeding ten (10) square feet in area.
3.5.5.4 Roof signs are prohibited in Residential Districts
3.5.6 In Business Districts
3.5.6.1 Sign Area
A business may have sign area not to exceed forty eight (48) square feet placed on the building wall. Free standing signs shall not exceed forty eight (48) square feet. For a building with multiple businesses, a business directory shall not exceed forty eight (48) square feet. Any sign proposal that exceeds the permitted maximum shall require a Special Permit from the Planning Board. For wall signs five (5) percent of the building facade shall determine maximum permitted sign area. The dimensions used in calculating this percentage shall be the horizontal measure of the frontage of the business and the vertical measure not exceeding the top of the second story of a building.
3.5.6.2 Pole signs shall not exceed twenty (20) feet above ground level.

The map panels of the Plymouth County FIRM that are wholly or partially within the Town of Mattapoisett are panel number 25023C0553J, 25023C0554J, 25023C0558J, 25023C0561J, 25023C0562J, 25023C0563J, 25023C0564J, 25023C0566J, 25023C0567J, 25023C0568J, 25023C0569J, 25023C0627J, and 25023C0650J with an Effective Date of July 17, 2012, and panel numbers 25023C0564K, 25023C0567K, and 25023C0568K with an Effective Date of February 5, 2014. The exact boundaries of the District may be defined by the 100-year base flood elevations shown on the FIRM Maps and further defined by the Plymouth County Flood Insurance Study (FIS) Report with an Effective Date of July 17, 2012.
