Notice is hereby given the Town of Mattapoisett will consider amendments to the existing Mattapoisett Zoning Bylaws, Article 3.8, Cluster Subdivision (Single Family de-attached) at the 2014 Special Town Meeting.
A Public Hearing pursuant to M.G.L. Ch. 40A will be held on April 6, 2015 at 7:00pm in the Conference Room of the Mattapoisett Town Hall, 16 Main Street, Mattapoisett, MA 02739. At which time public comment will be received.
Amendments are as follow:
Add a new Subsection 3.8.4.4 to read as follows:
3.8.4.4 Zero-Lot line Lots

3.8.4.4.1
Up to twenty (20) percent of the lots in a Cluster Subdivision may be designed as zero-lot line lots, provided the entire Cluster Subdivision is served by a public sewer system. A zero-lot line lot is a single-family residential lot created with no side-yard setback on one side of the lot, thereby creating a shared building envelope between two adjoining lots. This shared building envelope shall only be used to build a duplex where the common wall between the two units is the common boundary line separating the two adjoining residential lots. No lot can have more than one side yard with a zero setback.

3.8.4.4.2
The following minimum dimensional regulations shall apply to zero-lot line lots in lieu of those identified in Article 6, for conventional single-family developments:

Minimum Lot Area 10,000 square feet
Minimum Lot Frontage 45 feet
Minimum Front Yard Setback 25 feet
Minimum Side Yard Setback 0 feet (shared side) / 20 feet (unshared side)
Minimum Rear Yard Setback 10 feet
Maximum Lot Coverage 25 percent
Maximum Building Height 35 feet

The Mattapoisett Conservation Commission will hold a Public Hearing on Monday, April 13, 2015 at 6:30 p.m. in the Mattapoisett Town Hall on a Request for a Determination of Applicability submitted by Merry Suzan McCleary.
The Applicant proposes to construct an addition which will consist of a first floor porch and attached garage and second story living space, to install a paved driveway and construct a pervious patio, all within an existing open lawn area.
All work will be performed within Land Subject to Coastal Storm Flowage.

The Mattapoisett Conservation Commission will hold a Public Hearing on Monday, April 13, 2015 at 6:30 p.m. in the Mattapoisett Town Hall on a Notice of Intent submitted by Jay Duker & Julie M. Starr-Duker.
The Applicants propose to construct a pile supported timber pier and install a gangway, float and float anchor piles for the purposes of providing access to the waters of Aucoot Cove for recreational boating, fishing and swimming.
The proposed work will be partially performed within wetland resource areas bordering vegetated wetland, barrier beach, coastal beach, salt marsh, land under ocean, land containing shellfish and land subject to coastal storm flowage.
The project is located at 112 Aucoot Road and is further identified as Lot #62 on Mattapoisett Assessors Map #3. 3/26
