To see if the Town will amend Section 3.1 of the Zoning By-laws by adding a NEW Zoning District entitled "Neighborhood Overlay District (NOD).

PLANNING BOARD
The Marion Planning Board will hold a Public Hearing on Monday, May 5, 2008 at 8:00 PM in the Main Conference Room of the Marion Town House to consider the following amendment to the Zoning By-law or do or take any action related thereto.
To see if the Town will vote to amend Section 4.2 by adding a NEW column with the abbreviation "NOD" to the immediate right of the abbreviation "CP" as currently printed.
ALSO, insert a new Residential Use under the heading "Residential Use," below the words "Conservation Subdivision" to read: "Multifamily Residence (See Section 5.3)" and insert the letters "PB" in the column abbreviated as "NOD" to coincide with this entry.
ALSO, in Section 5.3, Multifamily Residence: (a) delete the final sentence in Section 1, "Purpose"; (b) delete the second sentence in the second paragraph of Section 1 and REPLACE as follows: "Multifamily Residence developments shall require a special permit and site plan approval from the Planning Board pursuant to Sections 7 and 9 of the Zoning Bylaw".
The amended section shall read:
1. Purpose
Regulations covering multifamily housing are enacted to encourage a limited amount of rental or ownership housing in Marion at a relatively low density to facilitate affordable housing and construction needs. Such housing must be served by public sewer and water.
Multifamily Residence developments shall require a special permit and site plan approval from the Planning Board pursuant to Sections 7 and 9 of the Zoning Bylaw.
ALSO, insert the letter "N," the letter "Y," and the letters "PB" for all entries below the "NOD" column as these letters are currently inserted under the column for the "General Business (GB)" district. Where the letters "BA" are found under the column for the "General Business (GB) district, insert the letters "PB" below the "NOD" column.
ALSO, add the following as a final sentence within Section 4.2 prior to the Table of Principal Use Regulations: "Where a conflict exists between uses permitted, prohibited or permitted by special permit within the Neighborhood Overlay District, the requirements pursuant to the column identified in Section 4.2, Table of Principal Use Regulations for Neighborhood Overlay District (NOD) shall control.

At the March 26, 2008 meeting of the Mattapoisett Board of Water/Sewer Commissioners, it was voted unanimously to amend the Entrance Fee as provided under Article II, Section II of the Mattapoisett sewer use regualtions as follows:

Under Article II, Section II, the Board hereby amends the Sewer Entrance Fee as $8,000 per unit for connections into the sewer system.

REQUEST FOR PROPOSALS
DISPOSITION OF REAL PROPERTY FOR THE DEVELOPMENT OF AN
AFFORDABLE HOUSING PROJECT AT
LITTLENECK VILLAGE, MARION, MA
The Town of Marion Affordable Housing Trust, acting through the Office of the Town Administrator and Chief Procurement Officer, invites sealed proposals from affordable housing developers to lease or acquire real property identified as Littleneck Village consisting of approximately 9.9 acres of land located at 330 Wareham Road, Marion, Massachusetts, as further described in the RFP. The Trust seeks sealed proposals from qualified bidders to design, finance, construct and operate at least forty-two (42) affordable housing rental units. Proposal documents may be obtained during normal business hours at the Selectmen's Office, Two Spring St., Marion, MA until 10:00 AM on Thursday, June 12, 2008, the deadline for submission of proposals. The Town of Marion reserves the right to reject any and all proposals if it is in the best interest of the Town to do so.

10. Notwithstanding any language to the contrary found within the Zoning Bylaw, a lot within the Neighborhood Overlay District may contain more than one principal use and/or structure and/or more than one accessory use and/or structure.

The Planning Board may grant a special permit for a use(s) or structure(s) with zero lot line setbacks where the Planning Board concludes, in its sole judgment, that such construction will help preserve open space, the aesthetic and visual design characteristics of the neighborhood and/or structures, will promote pedestrian and vehicular circulation and otherwise lead to an environmentally sensitive and appropriate development, and promote and protect public health and safety.
ALSO, add the following as a final sentence within Section 5.1 prior to the Dimensional Requirements Table: "Where a conflict exists between the dimensional requirements as set forth in Section 5.1 and those included within the Neighborhood Overlay District, the requirements pursuant to the Neighborhood Overlay District (NOD) shall control.
